Federal Court Rules ObamaCare Tax Subsidies Unlawful
WASHINGTON, D.C. – Today, The U.S. Court of Appeals for the D.C. Circuit ruled 2-1 that ObamaCare tax subsidies, a pillar of the scheme, are unlawful in the 36 states using federally-run insurance marketplaces. Rep. Tim Huelskamp issued the following statement:
“President Obama and his administration have waived, changed, delayed or ignored the law 36 times. Today, the D.C. Circuit Court of Appeals affirmed what we already knew: ObamaCare is unworkable, unaffordable, and its very implementation by the IRS is likely unlawful. Members of Congress like myself have fought against this lawless behavior. We were right to do so, and we must continue to oppose ObamaCare until it can be repealed.”
The 4th Circuit issued a separate decision today disagreeing with the DC Circuit. This means that the U.S. Supreme Court is likely to hear the case and ultimately decide this issue of tax subsidies.
